Report: Council Code of Conduct Bylaw No. 8408, 2023

The purpose of this report is to obtain Council approval of a new proposed Code of Conduct Bylaw No. 8408, 2023 that will replace the existing Council Code of Conduct Policy. Mr. Reece Harding from the law firm of Young Anderson will make a presentation at this Council meeting on the proposed Code of Conduct Bylaw and answer any questions that Council may have.

• Recommendation:

  That Council approve the Code Conduct Bylaw No. 8408, 2023 for First Reading and direct staff to commence a search for an Ethics Commissioner.

CONSENT AGENDA

If Council decides, all the recommendations in the reports on the Consent Agenda can be approved in one motion, without discussion. If Council wishes to discuss a report, that report is removed from the Consent Agenda. A report may be removed in order to discuss it, because someone wants to vote against the report’s recommendation, or because someone has a conflict of interest with the report. Any reports not removed from the Consent Agenda are passed without discussion.

Additional Public Consultation Events Summary Report: 422 Sixth Street (Circulated Separately)

The purpose of this report is to request Council’s endorsement to work with the applicant to implement recommended mechanisms that respond to the issues raised during the application review process.

• Recommendation:

  THAT Council direct staff to work with the applicant to implement the recommended mechanisms in response to issues raised during the application review process, including the two events held on June 19, 2023.

2022 Statement of Financial Information

To seek Council’s approval of the 2022 Statement of Financial Information.

• Recommendation:

  That Council receive and approve the attached 2022 Statement of Financial Information.

Development Variance Permit (300 Duncan Street, 313 to 327 Blackley Street, and 326 to 340 Mercer Street): Permit to Vary Off-Street Visitor Parking and Permit Tandem Parking – Notice of Consideration of Issuance

To request that Council issue notice that it will consider a Development Variance Permit (DVP00696) to reduce the required off-street visitor parking by 43% and permit tandem parking for a mixed-use, multi-family development at 300 Duncan Street, 313 to 327 Blackley Street, and 326 to 340 Mercer Street.

• Recommendation:

  THAT Council provide notice that it will consider issuance of a Development Variance Permit (DVP00696) to reduce the required off-street visitor parking by 43% and permit tandem parking for a mixed-use, multi-family development at 300 Duncan Street, 313 to 327 Blackley Street, and 326 to 340 Mercer Street.

Official Community Plan Amendment, Rezoning and Development Permit Application: 805 Boyd Street – Preliminary Report

To seek Council’s approval to process the proposed Official Community Plan Amendment, Rezoning and Development Permit applications for a four-storey self-storage facility at 805 Boyd Street as outlined within this report.

• Recommendation:

  THAT Council direct staff to work with the applicant to prepare plan of development for the subject property suitable for consideration of First and Second Readings, as outlined in the “Application Review Process” section of this report.

  THAT Council direct staff to advise and consult with the following:

  1. Give consideration to the requirements of Section 475 and 476 as well as other relevant sections of the Local Government Act;
  2. Direct staff to advise and consult with the following:
     1. The Ministry of Transportation and Infrastructure; and
     2. The following First Nations:
        1. Cowichan Tribes;
        2. Halalt First Nation;
        3. Katzie First Nation;
        4. Kwantlen First Nation;
        5. Kwikwetlem First Nation;
        6. Lyackson First Nation;
        7. Lake Cowichan First Nation;
        8. Musqueam Nation;
        9. Penelakut Tribe;

     3. As part of the notification requirements for a Public Hearing, require the applicant to include notice of the proposed OCP Amendment on the site signage required for the subject application.
  4. Not require consultation with:
     1. Board of the regional district in which the area covered by a plan is located (Metro Vancouver);
     2. The Board of Education of New Westminster Schools;
     3. Any greater boards or improvement districts;
     4. Greater Vancouver Sewerage and Drainage District Board; and
     5. Councils of immediately adjacent municipalities;

        as none are considered to be affected by this application.

Report Back on Safety Concerns at Eastbound Tenth Avenue Between First Street and McBride Boulevard (Circulated Separately)

To report back to Council in response to a motion adopted on April 3, 2023 requesting information regarding safety concerns for road users on Tenth Avenue between First Street and McBride Boulevard.

• Recommendation:

  THAT Council receive this report and confirm that the April 3, 2023 motion has been addressed to its satisfaction.

4.7

Response to Council Motion Re: Removal and replacement of dead and/or dying trees on City property

The purpose of this report is to provide information on the implications associated with Council’s March 27, 2023 motion regarding the timely removal and replacement of dead and/ or dying trees on city-owned lands, and make a recommendation regarding a path forward.

• Recommendation:

  THAT Council adopt Alternative Approach “B” to bring forward a funding proposal for consideration as part of the 2024 budget deliberations to complete a tree inventory in 2024, and implement the installation of replacement trees in an accelerated, but phased approach, over a number of years.

An amendment to reflect current requirements of the Provincial Integrated Pest Management Regulation.  This bylaw is on the agenda for ADOPTION.

Subdivision and Development Control Amendment Bylaw No. 8369, 2023

An amendment to improve the City’s development projects processes by providing clarity to applicants regarding the City’s Offsite Works and Services standards and design requirements. This bylaw is on the agenda for ADOPTION.

8.1

Notices of Motion

a.

Statement of Opposition to the Trans Mountain Pipeline Project

Submitted by Councillor Nakagawa

WHEREAS the City of New Westminster has endorsed the Fossil Fuel Non-Proliferation Treaty, has developed the Seven Bold Steps for Climate Action, and has previously opposed the Trans Mountain Pipeline expansion project as an intervenor; and 

WHEREAS the City of New Westminster has concerns about the impacts to the Fraser River stemming from the pipeline crossing near the Port Mann bridge;
 
THEREFORE BE IT RESOLVED THAT the City of New Westminster file a Statement of Opposition to the Trans Mountain Pipeline project that is traversing the Fraser River (stal̕əw̓) to the Canada Energy Regulator website.

NEW BUSINESS

9.1

ON TABLE City Staff’s Heat Plan Response to Extreme Heat in New Westminster: Accelerated Funding for Summer 2023 – Recommendation from the Utility Commission

The purpose of this report is twofold: one, to provide Council with the recommendations from the Utility Commission regarding the City’s response to extreme heat; and two, to provide Council with staff’s Heat Plan with an accelerated workplan and one-time budget request for summer 2023.

• Recommendation:

  THAT Council endorse the recommendation from the Utility Commission set out in this report; and

  THAT Council endorse the accelerated Heat Plan response workplan and the $268,000 one-time budget increase to be funded from the Climate levy, collected from electic utility bills in the Climate Action Reserve Fund; and

  THAT Council direct staff to pursue the following Next Steps as outlined in this report:

  (a) Direct staff to seek endorsement of the budget amount from the Utility Commission;
  
  (b) Direct staff to bring this report back at the July 10, 2023 Regular Council meeting for Council approval or rejection

12.1

2022 Annual Water Quality Monitoring Report

The purpose of this report is to present the 2022 Annual Water Quality Monitoring Report to Council. This report is an annual requirement to summarize and maintain a record of the water quality monitoring data collected during the subject year.

12.2

2023 Federation of Canadian Municipalities (FCM) Conference Summary of Potential Opportunities

The Federation of Canadian Municipalities (FCM) 2023 Annual Conference and Trade Show took place from May 25 to 28th 2023 in Toronto, Ontario. It is the largest pan-Canadian gathering of elected officials assembled to address a range of municipal issues. This report summarizes several potential opportunities for follow up, based on Council and staff priorities. Intergovernmental Relations (IGR) staff provided support to Council attending the convention.

Administration of City Grants and 2023 Awards

This report informs Council about the administration of City Grants and the 2023 awards.

British Columbia Electoral Boundaries Commission Reform Recommendations Update - June 2023 (Circulated Separately)

This report outlines the recommendations of the Final Report of the BC Electoral Boundaries Commission regarding proposed changes to the BC Electoral Boundaries in New Westminster.

Energy Save New West 2022 Impact Report and 2023 Initiatives (Circulated Separately)

The purpose of this report is to provide Council with an update on Energy Save New West program impacts in 2022, and to describe the 2023 initiatives that support Bold Step 3: Carbon Free Homes and Buildings, Bold Step 4: Pollution Free Vehicles and Bold Step 5: Carbon Free Energy.

Report Back on School Zone Enforcement Hours (Circulated Separately)

To provide Council with an update on its motion of February 27, 2023 to consider extended school speed zone enforcement hours.
